1. Acceptance of Terms

These Terms and Conditions (“Terms”) govern all purchases, downloads, and use of digital products offered by Max2712 Productions (“Seller”, “we”, “us”) via the Sellfy platform.

By placing an order, completing checkout, or accessing the product, you agree to be bound by these Terms.

3. Products and Digital Content

(1) The Seller provides digital products, in particular game modifications ("Mods") designed for use with Euro Truck Simulator 2 ("ETS2") and/or American Truck Simulator ("ATS"), including configuration files and related digital content.

(2) All products are delivered digitally. No physical goods are shipped.

(3) Unless otherwise stated in the product description, all products are developed for the latest officially supported version of Euro Truck Simulator 2 or American Truck Simulator available at the time of their release or most recent update.

(4) The products are intended for singleplayer use and the game’s built-in Convoy mode only. The third-party multiplayer mode "TruckersMP" is not supported. Compatibility with TruckersMP is explicitly excluded.

4. Contract Formation

(1) Product listings constitute an invitation to purchase and do not represent a binding offer.

(2) By completing checkout, the customer submits a binding offer.

(3) The contract is concluded upon confirmation of the order or provision of digital access, whichever occurs first.

5. Prices and Taxes

(1) All prices are base prices for digital products.

(2) Final prices, including applicable VAT or other taxes, are calculated and displayed at checkout based on the customer’s location and applicable tax laws via the Sellfy platform.

(3) VAT is applied where legally required.

6. Payment

(1) Payment is processed via Sellfy through the available payment methods, including but not limited to:

  • PayPal
  • Stripe (Credit/Debit Card)

(2) The Seller does not store full payment details. Payment processing is handled by the respective payment provider.

7. Delivery and Availability

(1) Delivery is carried out electronically via the Sellfy platform, including download links on the order confirmation page, customer account access, and automated order confirmation/invoice emails containing access or download instructions.

(2) Delivery occurs after successful payment.

(3) The customer is responsible for ensuring that their system and internet connection are suitable for downloading and using the product.

(4) The Seller does not guarantee uninterrupted availability of Sellfy or any third-party infrastructure.

8. License Grant (EULA)

(1) Upon successful purchase, the customer receives a non-exclusive, non-transferable license to use the purchased digital product for personal use only.

(2) The customer does not acquire ownership of the product or its assets.

(3) Unless explicitly stated otherwise in the product description, the license is granted for an unlimited period.

9. License Restrictions

The customer is strictly prohibited from:

  • redistributing, reselling, leasing, sublicensing, gifting or sharing the product files;
  • uploading the product (or parts of it) to file-sharing platforms, forums, Discord servers, or other public/private distribution channels;
  • modifying the product for redistribution or claiming authorship;
  • reverse engineering, decompiling or attempting to extract protected assets, unless permitted by mandatory law;
  • using the product in violation of applicable law, third-party rights, or game terms of service.

Violation of these restrictions may result in immediate termination of the license without refund and may lead to legal action.

10. Support, Updates and Compatibility

(1) The Seller is committed to providing long-term support for all purchased products and will make reasonable efforts to maintain, improve, and update them whenever reasonably practicable.

(2) The Seller aims to keep all products compatible with future versions of the supported game for as long as reasonably practicable. However, continued support, updates, and compatibility cannot be guaranteed.

(3) The products depend on third-party software, including Euro Truck Simulator 2 and/or American Truck Simulator, which may receive updates, engine changes, or other modifications beyond the Seller's control. Such changes may render a product partially or permanently incompatible or technically impossible to update.

(4) Where reasonably feasible, the Seller will make reasonable efforts to restore compatibility. However, the Seller is under no obligation to fundamentally redesign or redevelop a product if continued support is no longer technically or economically reasonable.

(5) Support includes reasonable assistance with installation, basic usage, troubleshooting, and product-related questions. Support does not extend to issues caused by unsupported game versions, third-party modifications, user-made modifications, or software outside the Seller's control.

11. Third-Party Disclaimer

(1) The Seller is not affiliated with, endorsed by, or connected to the publisher or developers of the underlying game.

(2) All trademarks, brand names, and game titles are the property of their respective owners.

(3) The customer acknowledges that using Mods may affect game performance or stability.

12. Right of Withdrawal (Consumers)

If you are a Consumer located in the European Union/EEA/UK, you may have a statutory right of withdrawal.

12.1 Digital Content Notice

For digital content not supplied on a tangible medium, the right of withdrawal may expire once performance has begun.

By purchasing and downloading/accessing the digital product, you agree that:

  • the Seller begins performance immediately, and
  • you acknowledge that you lose your right of withdrawal once the download or access begins.

Sellfy may request confirmation of this consent during checkout.

13. Refund Policy

(1) As a general rule, refunds are granted only if the digital product has not been downloaded or accessed.

(2) If a download has started or access has been granted, refunds are generally excluded due to the nature of digital goods, unless mandatory consumer protection laws require otherwise.

(3) Refund requests must be submitted within a reasonable time after purchase and must include proof of purchase.

(4) The Seller reserves the right to refuse refunds in cases of suspected fraud, abuse, or chargeback threats.

14. Warranty (Digital Content Conformity)

(1) The Seller is responsible for delivering digital content that conforms to the contract at the time of delivery.

(2) Conformity is assessed based on:

  • product description,
  • stated functionality,
  • and supported game version/environment at release.

(3) The Seller will make reasonable efforts to maintain compatibility with future game updates where reasonably practicable. However, compatibility with future game updates, patches, or third-party modifications cannot be guaranteed.

14.1 Consumer Rights

Consumers are entitled to statutory remedies, including repair or replacement where applicable under EU law.

15. Liability

(1) The Seller is fully liable for intent and gross negligence, and for injury to life, body, or health.

(2) In cases of slight negligence, liability is limited to essential contractual obligations and foreseeable damages typical for this type of contract.

(3) The Seller shall not be liable for incompatibilities resulting from updates, patches, engine changes, or other modifications made to the underlying game or third-party software.

(4) No guarantee is given for uninterrupted or permanent functionality.

16. Account and Download Security

(1) Customers are responsible for securing their download links and access data.

(2) If the customer suspects unauthorized access, they must notify the Seller immediately.

(3) The Seller may block access if there is reasonable suspicion of piracy, abuse, or unauthorized sharing.

17. Intellectual Property

(1) All copyrights, trademarks, and intellectual property rights in the digital products remain with the Seller or the respective rights holders.

(2) The customer is granted only the license described in these Terms.

18. Prohibited Use

The customer may not use the product:

  • for illegal purposes,
  • to infringe third-party rights,
  • to distribute malware or harmful code,
  • in connection with cheating services for online competitive multiplayer systems.

19. Termination of License

(1) The license automatically terminates if the customer violates these Terms.

(2) Upon termination, the customer must delete all copies of the product.

(3) Termination does not affect the Seller’s right to claim damages.

20. Data Protection

Personal data is processed according to applicable data protection laws.

21. Applicable Law

(1) These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

(2) Mandatory consumer protection laws of the customer’s country of residence remain unaffected.

22. Jurisdiction

(1) If the customer is a Business Customer, the exclusive place of jurisdiction is the Seller’s place of business in Germany.

(2) For Consumers, statutory jurisdiction rules apply.

23. Severability Clause

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

The invalid provision shall be replaced by a valid provision that most closely reflects the intended economic purpose.
